Delaware State Labor Laws

  • Delaware is one of the states where you will definitely find the working condition to be of very high standard. It is one of the states which are located at the Atlantic coast in the mid Atlantic region of the US. It has some of the best labor laws among many US states.

    Some of the facts about the labor laws are as follows:

    1. Employee minimum wages
    The minimum wage of the employee in Delaware is about $7.25 per hour which is quite good. However this rate is quite low for the workers who receive the tips. For them the rate is around $2.23 per hour. However the employers will have to pay more if they do not receive the tips. The employer will have to pay some extra amount if the employee works for extra hours. if the employee works for more than 40 hours a week then the employer will have to pay one and half times the normal payment rates. For example if the rate is $8.00 and the employees works for three extra hours in a week. Then he will be paid at $12 per hour. This means that he will get $36 as extra.

    As far as the exemption from the minimum wages is concerned, such people includes agriculture, employees in domestic homes or private homes, outside commission paid sales representative, bona fide executive, administrator and professionals, employees who are engaged in fishing and so on.

    2. Wage payment and collection
    The employers must make sure that the wage is paid at least one every month. The employees must be paid within seven days if he is fired. This is mandatory and every employer should strictly follow it. Otherwise the employee has all the rights reserved to question the employer in court.

    3. Child Labor Laws
    Let me tell you that the minimum age required for working is around 14 years. Children below this age are not permitted to work. The child law is applicable to the child between the age 14 and 17.  There are some more laws as well. For example the child will not have to work for more than four hours on school days. On holidays as well they should not be asked to work more than 4 hours a day. They too cannot be asked to work more than 6 days a week. They will also not have to work more than 40 hours a week.

    As per the women employees, they are well protected from the threat of sexual harassment. Let me tell you that as an employer you will have to give the employee a special respect.

    These are some of the laws which you will have to follow when you are in Delaware failing which can lead to severe problems.
